Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TuitoMate at https://tuitomate.com (“Service”), operated by TuitoMate (“we”, “us”, “our”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TuitoMate provides tools for solo tutors, including lesson scheduling, payment tracking, student progress, resources, optional Google Calendar sync, and optional AI-assisted features. Features may change over time.

2. Eligibility and accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to register.
  • You must provide accurate account information and keep credentials secure.
  • You are responsible for all activity under your account.

3. Subscriptions and billing

  • Paid plans are billed through Stripe on a recurring basis unless stated otherwise.
  • Some plans may include a free trial at signup. When a trial applies, billing starts automatically after the trial period unless you cancel before it ends. Trial length and eligibility are shown at checkout.
  • Free trials are limited to once per email address within a cooldown period (typically 365 days, as shown at signup). We record trial usage by email even if you later delete your account.
  • Prices and features are described on our pricing page; we may change prices for future billing periods with notice where required.
  • You may cancel according to in-app billing settings; access may continue until the end of the paid period unless otherwise stated.
  • Refunds are handled according to our billing policy and applicable law (contact us if unclear).

4. Your content and student data

  • You retain ownership of data you upload (“Your Content”).
  • You grant us a limited licence to host, process, and display Your Content solely to operate and improve the Service (including syncing to Google Calendar when you enable it, and sending content to AI providers when you use AI features).
  • You represent that you have the right to collect and process student/parent data you enter, and that you will comply with applicable privacy laws (including obtaining any required consents).
  • When you enter student or guardian personal data, our Data Processing Addendum (DPA) applies: you are the data controller and we act as processor solely to provide the Service, as described in our Privacy Policy. Contact us for a copy of the DPA if you need one for your records.
  • You must not upload unlawful, defamatory, or infringing content.

5. Google Calendar

  • Google Calendar sync is optional and requires you to authorise our app via Google OAuth.
  • Sync is one-way (TuitoMate → a dedicated “TuitoMate Calendar”). We are not responsible for changes you make directly in Google Calendar that conflict with TuitoMate.
  • You may disconnect at any time in Settings. See our Privacy Policy for how Google data is handled.

6. AI features

  • AI-generated content may be inaccurate or incomplete. You are solely responsible for reviewing outputs before use with students or parents.
  • Do not rely on the Service for professional, legal, medical, or safeguarding advice.

7. Acceptable use

You agree not to:

  • Violate laws or third-party rights.
  • Attempt to breach security, scrape the Service excessively, or interfere with other users.
  • Reverse engineer the Service except where legally permitted.
  • Use the Service to send spam or malware.

We may suspend or terminate accounts that violate these Terms.

8. Intellectual property

We own the Service, software, branding, and documentation. These Terms do not grant you ownership of our intellectual property.

9. Third-party services

The Service integrates with third parties (e.g. Google, Stripe, Resend, Google Gemini, Sentry). Your use of those services is subject to their terms and policies. We are not responsible for third-party outages or actions.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR SGD 100 IF YOU HAVE NOT PAID FEES).

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.

12. Indemnity

You agree to indemnify and hold us harmless from claims arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, risk to the Service, or legal requirements. Provisions that by nature should survive (e.g. disclaimers, liability limits) will survive termination.

14. Governing law and disputes

These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules. Courts in Singapore shall have exclusive jurisdiction, unless mandatory consumer protection laws in your country require otherwise.

15. Changes

We may modify these Terms. We will post updates at https://tuitomate.com/terms. Material changes may be notified by email or in-app notice where appropriate. Continued use after the effective date constitutes acceptance where permitted.
